Brutal Legend release hearing delayed

According to an Associated Press report, Los Angeles Superior Court Judge Craig Karlan has adjourned a hearing as to whether the release of Tim Schafer's Brutal Legend should be delayed until August 6.

Karlan tentatively indicated that he would likely not be supporting Activision's application to have the release of the title delayed, reportedly stating that he 'can't say there's a likelihood of success here'.

Activision is seeking to hold the title back from market until a legal stoush as to publishing rights is resolved. Activision sued the game's developer, Double Fine Productions, in June this year, alleging that it never relinquished its rights to publish the action adventure and that the developer's subsequent deal with rival Electronic Arts is void. Karlan reportedly indicated that in his view, the resolution of the issue would be tricky, stating that the case was 'going to be a close call'.

Brutal Legend remains slated for release in Australia on October 16 for Xbox 360 and PlayStation 3.

Good news that's it's most likely not going to be delayed. Wonder what the heck Activision was thinking with dropping the title but still trying to hold the rights.

Hopefully they won't delay it past Rocktober, I can't think of a suitable pun for November.

They were probably thinking that they didn't want anybody else to release the game either.
